These Terms of Service ("Terms") govern your access to and use of realestatemaps.app and related services (the "Service") operated by realestatemaps.app ("we," "us," or "our"). By creating an account, starting a trial, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By accessing or using the Service, you confirm that you are at least 18 years old, have authority to bind yourself or the organization you represent, and accept these Terms and our Privacy Policy. We may update these Terms from time to time. Material changes will be posted on the Service with an updated effective date. Continued use after changes constitutes acceptance.

2. Description of Service

realestatemaps.app is a commercial software-as-a-service (SaaS) platform for commercial real estate (CRE) mapping and geospatial analysis. The Service provides an interactive map workspace with layers including parcel and property data, flood hazard zones, demographics overlays, retailer brand locations, points of interest, and measurement tools. Access to premium features requires an active paid subscription unless otherwise stated. We may modify, suspend, or discontinue features with reasonable notice where practicable.

3. Account Registration & Clerk Auth

You must register for an account to use the Service. Authentication is provided through Clerk, which supports OAuth and email/password sign-in. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us promptly at legal@realestatemaps.app if you suspect unauthorized access. We are not liable for losses arising from your failure to secure your account.

4. Subscription & Billing

Paid subscriptions are processed through Stripe. Current plans are $100 per month or $1,000 per year, subject to change with notice. New subscribers may receive a 7-day free trial as offered at signup; you may cancel before the trial ends to avoid charges.

Subscriptions renew automatically at the end of each billing period unless canceled through the Stripe customer billing portal or as otherwise provided in the Service. You authorize us and Stripe to charge your payment method on each renewal date. Fees are non-refundable except where required by law. We do not provide prorated refunds for partial billing periods after a charge has been processed. Failure to pay may result in suspension or termination of access.

5. Acceptable Use

You agree not to:

  • Scrape, crawl, or systematically extract data from the Service or its APIs
  • Perform bulk export of map data, parcel records, or other licensed content except through features we explicitly provide
  • Resell, sublicense, or redistribute Service data or access to third parties
  • Reverse engineer, decompile, or attempt to derive source code from the Service
  • Access the Service through any automated means — bots, scripts, scrapers, headless browsers, or browser-automation/agent tools (including AI agents that drive a browser) — other than features we explicitly provide
  • Circumvent, disable, bypass, or interfere with any rate limit, access control, authentication, or other technical protection measure of the Service (including circumvention of access controls or rate limits as prohibited by 17 U.S.C. §1201), including measures protecting our copyrighted software, interface, and curated datasets
  • Interfere with the security, integrity, or infrastructure of the Service
  • Use the Service for unlawful purposes or in violation of third-party rights or of our data providers' terms (including, where applicable, our parcel-data provider's end-user license)

We may embed traceable canary/decoy records in our datasets to detect and prove unauthorized extraction, copying, or redistribution. The presence of such a record in any third-party product or export is evidence of a violation of these Terms.

We may investigate violations and suspend or terminate accounts without refund, and pursue all available legal remedies, including for breach of contract and circumvention of technical protection measures.

6. Intellectual Property

The Service, including its software, user interface, branding, documentation, and proprietary datasets we create or curate, is owned by realestatemaps.app or its licensors and is protected by intellectual property laws. Subject to these Terms and your subscription status, we grant you a limited, non-exclusive, non-transferable license to access and use the Service for your internal business purposes.

Parcel and property information displayed in the Service is aggregated from public county and government records and similar public sources. We do not claim ownership of underlying public record data. Third-party map tiles, geocoding, and platform components remain subject to their respective providers' terms.

7. Parcel & Property Data Disclaimer

Parcel, ownership, valuation, flood, demographic, and related geospatial data are provided "as is" and "as available" from public and third-party sources. Data may be incomplete, outdated, or inaccurate. The Service is not a title search, survey, legal opinion, or substitute for professional due diligence. You are solely responsible for verifying information before making business, investment, or legal decisions. realestatemaps.app disclaims all warranties regarding data accuracy or fitness for a particular purpose.

8. Limitation of Liability

To the maximum extent permitted by law, realestatemaps.app and its officers, employees, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, arising from your use of the Service or reliance on displayed data.

Our total aggregate liability for any claims arising out of or related to these Terms or the Service shall not exceed the fees you paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim. Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

9. Termination

You may cancel your subscription at any time through the billing portal; cancellation stops future renewals but does not entitle you to a refund for the current period except as required by law.

We may suspend or terminate your access immediately if you breach these Terms, fail to pay fees, or if we reasonably believe your use poses risk to the Service or others. Upon termination, your right to use the Service ends. Sections that by nature should survive (including intellectual property, disclaimers, limitation of liability, and governing law) will survive termination.

10. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles. You agree that courts located in the State of Texas, United States shall have exclusive jurisdiction over disputes arising from these Terms or the Service, except where prohibited by applicable consumer protection law.

11. DMCA / Copyright Infringement Notification

We respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (17 U.S.C. §512). If you believe content on the Service infringes your copyright, send a written notice to our Designated Agent containing:

1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf; 2. Identification of the copyrighted work claimed to have been infringed; 3. Identification of the material claimed to be infringing and information reasonably sufficient to locate it on the Service; 4. Your contact information (address, telephone number, and email address); 5. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and 6. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

Counter-Notification: If you believe material you posted was removed or disabled by mistake or misidentification, you may send a counter-notice containing your signature, identification of the material and its prior location, a statement under penalty of perjury that you have a good-faith belief the material was removed in error, your contact information, and a statement consenting to the jurisdiction of the federal court in the State of Texas, United States and accepting service of process from the person who filed the original notice.

Repeat Infringers: We will, in appropriate circumstances, terminate the accounts of users who are determined to be repeat infringers.
